Terms of Service

These Terms of Service explain the rules for using Nyxih, including the Nyxih website, Discord bot, Premium features, support services, and related online services.

By using Nyxih, adding the Nyxih bot to a Discord server, interacting with Nyxih features, or purchasing Premium, you agree to these Terms.

If you do not agree to these Terms, do not use Nyxih.

1. Service provider

2. What Nyxih is

Nyxih is a Discord bot and online service for Discord communities.

Nyxih may provide features such as:

  • server dashboard and control panel

  • permissions and role tools

  • onboarding and role picker tools

  • events

  • reminders

  • tickets

  • polls

  • tips

  • external feeds

  • leveling and member progression

  • voice tools

  • moderation and safety tools

  • themes and branding

  • Personal Tools

  • Personal Notes

  • mentions and sharing features

  • Premium features

Some features are available to all users or servers. Some features may require Premium.

3. Discord dependency

Nyxih operates through Discord and depends on Discord’s platform, API, permissions, uptime, policies, and technical behavior.

Nyxih is not Discord and is not affiliated with, endorsed by, or operated by Discord.

When using Nyxih through Discord, you must also follow:

  • Discord’s Terms of Service

  • Discord’s Community Guidelines

  • Discord’s Developer/API rules where applicable

  • the rules of the Discord server where Nyxih is used

  • applicable law

If Discord changes its platform, APIs, permissions, bot rules, monetization rules, or availability, Nyxih features may change, stop working, or become unavailable.

4. Server owner and administrator responsibility

Server owners and administrators decide whether to add Nyxih to a Discord server and which features to enable.

Server owners and administrators are responsible for:

  • configuring Nyxih lawfully and responsibly

  • choosing appropriate channels, roles, permissions, and settings

  • informing their community where required

  • handling server moderation decisions

  • ensuring their use of Nyxih follows Discord rules and applicable law

  • not using Nyxih to process data they are not allowed to process

Nyxih provides tools. Server owners and administrators remain responsible for how those tools are configured and used in their communities.

5. User responsibility

When using Nyxih, you agree to use the service responsibly.

You must not:

  • use Nyxih for illegal activity

  • upload, store, share, or distribute illegal content

  • harass, threaten, exploit, or abuse others

  • upload or share sexual abuse material, exploitative content, or content involving minors

  • use Nyxih for spam, phishing, malware, scams, or harmful automation

  • attempt to bypass permissions, access controls, safety systems, or security restrictions

  • attempt to break, overload, reverse engineer, or interfere with Nyxih

  • use Nyxih to violate Discord rules or applicable law

  • store third-party personal data without permission or another lawful basis

  • impersonate another person or misrepresent your authority over a server

6. Personal Notes

Nyxih includes Personal Notes features.

You are responsible for the content you store in Personal Notes.

You must not use Personal Notes to store:

  • illegal content

  • content you do not have the right to store

  • sensitive third-party personal data without permission or lawful basis

  • abusive, exploitative, or harmful content

  • malware, phishing material, stolen credentials, or secrets you are not allowed to store

Personal Notes are designed for personal organization and Discord-related workflows. They are not intended as a secure vault for passwords, financial secrets, medical records, government documents, or highly sensitive data.

Nyxih may restrict, remove, or block content where necessary for safety, legal, security, or abuse-prevention reasons.

7. Uploaded files and assets

Some Nyxih features allow users or server administrators to upload images, files, banners, logos, note attachments, or other assets.

You are responsible for uploaded content.

You must not upload files or assets that:

  • are illegal

  • infringe intellectual property rights

  • contain malware or harmful code

  • violate another person’s privacy

  • contain exploitative, abusive, or prohibited content

  • you are not allowed to upload or use

Nyxih may remove uploaded files or assets where necessary for legal, security, safety, storage, or abuse-prevention reasons.

8. Moderation and safety tools

Nyxih may provide moderation and safety tools to help server staff manage their communities.

Moderation tools may include automated rules, configurable filters, safety checks, staff review tools, AI-assisted review, or other safety-related features.

These tools are assistance tools. They are not legal advice, and they are not guaranteed to be perfect.

Server staff remain responsible for:

  • choosing appropriate moderation settings

  • reviewing moderation decisions where needed

  • handling appeals or disputes within their server

  • complying with applicable law and Discord rules

Nyxih may restrict or suspend access to moderation features if they are abused, used unlawfully, or used in a way that creates security, safety, or platform risk.

9. Premium

Nyxih offers optional Premium features for Discord servers.

Some features are available for free. Some features may require Premium.

Premium features, limits, prices, billing periods, and offers may be shown on the Premium page, inside the Nyxih bot Premium panel, or inside Discord’s official purchase flow.

Premium features, limits, prices, and availability may change over time. If a change materially affects an active paid plan, Nyxih will handle it in a fair and reasonable way according to applicable law and the relevant payment process.

Nyxih currently uses Discord-native monetization where available. This may include:

- a monthly Discord server subscription for Premium

- a limited Founder Pack one-time launch offer

Founder Pack is a limited one-time launch offer for one Discord server.

When applied to a server, Founder Pack grants:

- 12 months of Premium for that server

- permanent Founder status for that server

- doubled Premium numeric limits while that server has active Premium

Founder status stays attached to the server after the included 12 months ends, but Premium features and Founder-doubled limits require active Premium.

After the included Premium period ends, the server may need an active monthly Premium subscription to continue using Premium features and Founder-doubled limits.

Founder Pack must be applied to the intended server after purchase. Nyxih records the server grant before consuming or finalizing the Discord entitlement where required.

Legacy Annual Pack access, if any exists from earlier testing or limited rollout phases, is no longer publicly sold. Existing legacy access may remain active until its recorded expiry or until it is otherwise revoked, removed, or no longer valid.

Payment, renewal, cancellation, and refunds

Payments for Discord-native Premium subscriptions and Founder Pack purchases are handled through Discord’s official monetization and checkout systems.

Discord may handle checkout, billing, payment methods, subscription management, taxes, refunds, cancellations, fraud prevention, entitlement delivery, and related payment processes according to Discord’s own terms and policies.

Nyxih does not store full card details and does not directly process card payments for Discord-native Premium or Founder Pack purchases.

By purchasing Premium or Founder Pack through Discord, you may also be subject to Discord’s applicable checkout, subscription, refund, cancellation, tax, and legal terms.

Refunds and cancellations are handled according to:

- the applicable Discord payment flow

- the subscription or offer terms shown at the time of purchase

- Discord’s processes where applicable

- mandatory consumer protection law

If Discord revokes, refunds, deletes, expires, or otherwise invalidates an entitlement, Nyxih may remove or end the related Premium access.

If a monthly Premium subscription is canceled, Premium access may remain active until Discord’s entitlement evidence ends, expires, is deleted, or is otherwise no longer valid.

10.1 Right of withdrawal for EU consumers

If you are a consumer residing in the European Union, you may have a statutory right to withdraw from an online contract within 14 days without giving a reason.

For digital services or digital content, this right may expire earlier if you expressly agree that the service begins before the withdrawal period ends and acknowledge that you may lose your right of withdrawal once performance has begun or has been fully provided, where applicable by law.

The specific withdrawal, cancellation, and refund information shown during the payment process applies to the purchase.

Nothing in these Terms limits mandatory consumer rights under applicable law.

11. No public website checkout during limited rollout

During Nyxih’s limited rollout, the Premium page on the website is informational only.

Premium purchase access is intentionally limited to servers that already have Nyxih added and can access the bot Dashboard or Premium panel, or to Discord’s official purchase surfaces where available.

Nyxih does not currently offer public website checkout for Premium.

If Nyxih later adds a different public checkout flow, the website, Premium page, Privacy Policy, and these Terms may be updated before that flow is made available.

12. Availability and changes

Nyxih is still actively developed.

Features may be added, changed, limited, renamed, moved, or removed.

Nyxih may be unavailable because of:

  • maintenance

  • updates

  • server or hosting issues

  • Discord outages or API changes

  • database or storage issues

  • security incidents

  • payment provider issues

  • force majeure or events outside our control

We try to keep Nyxih reliable, but we do not guarantee uninterrupted, error-free, or permanent availability.

13. Data deletion

Nyxih provides privacy deletion flows.

Individual users can schedule:

Delete my data
Available from My Panel → Privacy & Data.

Server owners or authorized administrators can schedule:

Delete server data
Available from Control Panel → Privacy & Data.

Both deletion flows have a 7-day waiting period and can be canceled during that waiting period.

After the waiting period, Nyxih automatically processes due deletion requests through its privacy deletion worker.

Deletion may delete, detach, or anonymize data depending on the feature and the type of record.

Some records may be retained where required for:

  • payment processing

  • tax or accounting obligations

  • legal claims

  • fraud prevention

  • security

  • abuse prevention

  • moderation safety

  • deletion audit records

  • backup rotation

Nyxih’s privacy deletion flows do not automatically delete Discord public messages, Discord channels, Discord roles, or Discord server content outside Nyxih’s own stored data.

14. Bot removal grace period

When Nyxih is removed from a Discord server, Nyxih schedules a recoverable server-data deletion request.

This bot-removal deletion request is scheduled for 7 days later.

If Nyxih is re-added to the same server within the 7-day grace period, the bot-removal-created deletion request is canceled.

Admin-created Delete server data requests are not automatically canceled by re-adding the bot.

No immediate deletion happens when Nyxih is removed from a server.

The bot-removal grace process does not automatically delete Discord messages, channels, or roles.

15. Security and abuse prevention

Nyxih may take measures to protect the service, users, servers, and infrastructure.

This may include:

  • blocking abusive requests

  • limiting access to features

  • suspending access for security reasons

  • retaining minimal security records where needed

  • investigating suspected abuse

  • preventing fraud, spam, or misuse

  • protecting payment and Premium systems

  • complying with legal obligations

You must not attempt to bypass, disable, overload, or interfere with Nyxih’s security systems.

16. Intellectual property

Nyxih, including its name, branding, design, code, text, graphics, and service structure, is protected by applicable intellectual property laws.

You may not copy, reproduce, modify, redistribute, sell, or misuse Nyxih branding, content, or software except where allowed by law or with written permission.

You retain rights to content you lawfully provide, such as your own notes or uploaded assets, but you grant Nyxih the limited rights necessary to store, process, display, transmit, and manage that content for the purpose of providing the service.

17. Third-party services

Nyxih depends on third-party services.

These may include:

- Discord

- Hostinger

- Hetzner

- Cloudflare R2 or similar storage providers

- PostgreSQL, Redis, database, cache, and infrastructure providers

- email providers

- external feed providers where configured, such as Twitch, YouTube, Reddit, or RSS sources

- AI or safety service providers where enabled

- Discord monetization and entitlement systems for Premium and Founder Pack purchases

Nyxih is not responsible for outages, policy changes, errors, or decisions made by third-party services outside Nyxih’s control.

18. Suspension and termination

Nyxih may restrict, suspend, or terminate access to the service, a feature, Premium, or a server configuration if necessary for:

  • abuse prevention

  • security

  • legal compliance

  • payment or fraud issues

  • violation of these Terms

  • violation of Discord rules

  • risk to users, servers, Nyxih, or third parties

Where reasonable, we may provide notice. In urgent safety, legal, or security situations, action may be taken without prior notice.

19. Disclaimer

Nyxih is provided on an “as available” and “as is” basis.

We try to provide a reliable and useful service, but we do not guarantee that:

  • Nyxih will always be available

  • every feature will work without interruption

  • every moderation or safety decision will be perfect

  • every integration will remain available forever

  • Discord or third-party providers will not change their systems

  • data loss can never occur

Nothing in these Terms limits liability where liability cannot be limited under applicable law.

20. Limitation of liability

To the extent permitted by applicable law, Nyxih and the service provider are not liable for indirect, incidental, special, consequential, or punitive damages, loss of profits, loss of data, loss of business, server disruption, or damages caused by third-party services, Discord outages, configuration mistakes, or misuse of Nyxih.

This limitation does not apply where liability cannot be limited under applicable law, including liability for intent, gross negligence, injury to life, body, or health, or mandatory consumer protection rights.

21. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Nyxih and its provider from claims, liabilities, damages, losses, and reasonable expenses arising from your misuse of Nyxih, your violation of these Terms, your unlawful content, your server configuration, or your violation of third-party rights or applicable law.

This does not limit mandatory consumer rights or liability rules that cannot be limited by law.

22. Changes to these Terms

We may update these Terms when Nyxih changes, when legal requirements change, or when providers or features change.

Updates apply from the date shown at the top of this page.

If changes are material, we may provide additional notice where reasonable.

23. Governing law

These Terms are governed by the laws of Germany.

Mandatory consumer protection laws of your country of residence remain unaffected where they apply.

24. Consumer dispute resolution

We are not obliged and not willing to participate in dispute resolution proceedings before a consumer arbitration board.
